File your objection to Kinder Morgan/TGP's request for immediate permission for tree felling for all CT Expansion segments (MA, CT, NY)

Last Friday, KM/TGP filed a renewed request for Notice to Proceed with Tree Felling for the entire CT Expansion Project.  (Their initial request was filed last March, after receiving the FERC certificate.)

Kinder Morgan sees all our filings on the docket.  We need lots of comments there ASAP not just to inform FERC, but to let the company know that the people of Massachusetts, Connecticut and New York will not just step aside for this pipeline.

KM is anxious to complete tree felling before March 31st, during the "environmentally preferred window" to protect migratory birds. Today they filed their Biweekly Status Report, again claiming to have “received all federal permits needed for tree felling.” That's not quite true.  

In addition to not having a final section 401 water quality certification from MassDEP because of the ongoing appeal by Berkshire Environmental Action Team and PLAN-NE and others, there are several issues as yet unresolved that must be completed before FERC can consider allowing tree felling for the project.  

Please comment on Docket No. CP14-529 to make this clear to FERC!  This is a time-sensitive request.

- The Massachusetts 401 water quality certification is not yet final; the appeal is still pending.

- Felling trees and leaving them in place (as indicated in TGP's schedule filed with its request) would constitute filling wetlands under Massachusetts law, in violation of the Clean Water Act (as will be specified in any final 401 water quality certification issued by MassDEP).

- The eminent domain proceeding to take the land in Otis State Forest is not complete. The compensation settlement hearing is scheduled for Feb 6th.

- The tribal consultations are not complete.  Yesterday the Advisory Council on Historic Preservation stated they need to enter into an MOU for handling the 73 ceremonial landscape features found along the proposed right-of-way in Sandisfield. Under current plans, one third of these features will not be avoided during the construction process.

- TGP still has not certified the vernal pools in the path of the pipeline construction as prescribed by the Sandisfield Conservation Commission’s Order of Conditions for the project.

- The Request for Rehearing filed with FERC by S.T.O.P.  remains pending.  FERC must rule on the merits of this request.

DEEP Notice of Public Informational Meeting and Opportunity for Public Comments (Leading by Example: Reducing Energy Use in State Facilities). Urging the state to leave fossil fuel / natural gas off the table in the new Comprehensive Energy Strategy could eliminate the "need" for the Connecticut Expansion pipeline.
